Sephora Participation Terms and Conditions
The following Participation Terms and Conditions (“Terms and Conditions”) shall govern all attendance and participation in any events and classes (collectively, “Events”) organised Sephora Australia Pty Ltd (“Sephora”), either on its own or in conjunction with any of its brand partners, including where such Events are held physically in-person in any stores operated or managed by Sephora. References to “you” or “participant” refers to all individuals who have registered for any such Events or who attend any such Events.
Participants may only register for, and attend Events, in accordance with these Terms and Conditions.
By submitting a registration or RSVP to any such Events, you hereby agree to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, please do not submit any registration or RSVP to such Events or otherwise attend or participate in any such Events.
Please read these Terms and Conditions carefully.
1. General Limitations on Event Participation
a. General Limit for participation.
i. Each Participant will only be allowed to register and attend in three (3) Events in a single calendar month (“General Limit”).
ii. This restriction applies to all Events which are organised by Sephora (whether on its own or together with a third party (e.g., a brand partner)) in any venue within Australia. For the avoidance of doubt, attending multiple Events organised by Sephora together with different brand partners will still count towards this General Limit.
iii. Sephora reserves the right to reject or revoke registrations which exceed this General Limit. Any attempts to circumvent the General Limit in bad faith (e.g., using multiple e-mail addresses), if discovered, will also result in any of the following actions being taken by Sephora in its sole discretion:
1. Rejection or revocation of registration for the relevant Event; or
2. Limitations being placed on that Participant’s right to register and attend future Events.
b. Events with multiple sessions:
i. For individual Events which have multiple sessions at different times and/or locations, each Participant will only be allowed to register and attend one session per Event.
ii. Sephora reserves the right to reject registrations which have been made for multiple sessions for any single Event.
c. For the purposes of this Clause 1, a Participant will still be regarded to have attended an Event or session where he/she:
i. fails to show up to the Event; or
ii. cancels his/her registration with less than 24 hours notice.
2. Events Registration
a.Unless otherwise stated, all participants must be above the age of eighteen (18) in order to register for any Events.
b. To register for the Event, participants must.
i. submit a valid and complete registration form at the designated registration portal for that Event.
ii. for Events that are restricted to members of a certain Sephora membership tier, ensure that they have qualified for that that membership tier as of the date on which their registration form is submitted; and.
iii. pay all due registration fees if any (i.e., in the form of deduction of Beauty Pass points) (“Registration Fee”).
c. Unless otherwise stated, participant slots for all Events are limited and registrations will be processed on a first-come-first-serve basis. All registrations remain subject to availability and shall not be regarded as confirmed until the participant has received a written confirmation either via e-mail or mobile notification that his/her registration has been accepted (“Registration Confirmation”). Sephora reserves the right to close the registration portal or otherwise reject registrations once maximum occupancy has been reached.
d. In the event any participant who has received a Registration Confirmation (such participant, a “Registered Participant”) is unable to attend the Event for any reason, he/she may cancel their registration by clicking on the link in the Registration Confirmation.
3. Entry to Events
a. All Registered Participants will be required to produce (i) a valid Registration Confirmation; and (ii) a valid form of identification, for inspection and verification of identity prior to being granted entry and admission to the Event. Sephora shall have the right to request for verification of age, identity or any other information relevant to entry to the Event.
b. All Registered Participants acknowledge and agree that they (and/or their property) may be subject to a reasonable search upon entry to all Events, and any Registered Participant who refuses to comply may be denied entry.
c. Sephora reserves the right to refuse admission or to ask any Registered Participant to leave the Event and/or the premises in the event the Registered Participant:
i. fails to produce the documents described in Paragraph 2a above;
ii. fails to comply with the search measures described in Paragraph 2b above;
iii. arrives more than ten (10) minutes after the schedule start time for the Event;
iv. displays any inappropriate or disorderly conduct, or otherwise creates any concern for the safety and security of other Registered Participants, Sephora and/or its brand partner’s employees, officers, contractors, agents and/or representatives, or any other individual within the Event location and its neighbouring premises; or
v. is discovered by Sephora to have failed to comply with these Terms and Conditions.
4. Door gifts, Event kits and other Event-related promotional items
a. Sephora or its brand partners (as the case may be) may, in its sole and absolute discretion, arrange for door gifts to be distributed in-person to all Registered Participants (“Event Freebies”).
b. All Event Freebies are non-exchangeable, non-transferable, non-refundable and no cash alternative shall be offered.
c. All participants acknowledge that Sephora is entitled to substitute, replace, swap or change any such Event Freebies with alternative items which may or may not be of a equivalent or similar value to the original Event Freebie, or to do away with the Event Freebies entirely, and participants shall not be entitled to any compensation in the event that Sephora chooses to exercise its right to do so.
5. Changes to the Event
a. Sephora reserves the right to, at any time and for any reason:
i. change the Event program, capacity, times and/or schedules;
ii. change the Event location;
iii. postpone or reschedule the Event; or
iv. cancel to terminate the Event.
b. In respect of any such changes to the Event, Sephora shall endeavour to provide as much notice to Registered Participants as reasonably practicable, but participants acknowledge and agree that Sephora may not be able to do so for changes which are the result of sudden or unforeseeable occurrences, such as:
i. sudden unavailability of any host or key talent for the Event (e.g., due to health or illness); or
ii. any event or circumstance not reasonably within Sephora’s control, including abnormally inclement weather, flood, lighting, storm, fire, explosion, earthquake, pandemic, epidemic or other natural disaster, acts of God, failure or shortage of power supplies, war, terrorist action or the proximate threat thereof, military operations, riot, crowd disorder, strike, lock-out or other industrial or civil commotion, or any legislation, regulation, ruling of any relevant government, court or any competent national or international authority. For the avoidance of doubt, this shall include any quarantine, health, safety or stay-home measure, lock-down or other movement restriction imposed by any relevant government or national or international authority in connection with the coronavirus disease known as “COVID-19”.
c. Any changes in Event time, schedule or location, including any rescheduling or postponement, shall entitle all Registered Participants to a full refund of Registration Fees (if any) in the event that the Registered Participant is no longer able to attend the Event because of the change, provided that he/she notifies Sephora in writing that he/she will not be able to attend within 2 business days of receiving notification of the change.
d. In the event of any cancellation or termination of the Event, the sole and exclusive remedy for Registered Participants shall be a full refund of Registration Fees (if any). For the avoidance of doubt, Registered Participants shall not be entitled to any refunds or other compensation for Events which do not impose a Registration Fee.
e. Sephora shall not in any way be responsible for any damages, direct or indirect, resulting from any changes to the Event.
6. Participant’s Undertakings
a. All participants warrant and represent to Sephora that any information given or made available to Sephora in connection with the Event, including through the registration form, is true, complete and accurate in all respects and not misleading.
b. All participants acknowledge and agree that registration, attendance and participation in the Event is fully voluntary, and to the maximum extent permitted by law, all participants agree that it shall be solely responsible for any and all risks associated with their registration, attendance and participation in the Event.
7. Sephora’s Limitation of Liability
a. All participants acknowledge and agree that any information and views expressed by the hosts or talents at the Event, including representatives from any brand partners, are solely their own, and Sephora (including its affiliates and each of their officers, employees and agents) shall not be responsible for any such information and/or views.
b. Sephora does not pre-screen any content made available during the Events or otherwise exercise any executive or editorial control over such content, and Sephora (including its affiliates and each of their officers, employees and agents) shall not be responsible for the same.
c. Sephora does not make any warranties, undertakings or representations in respect of the accuracy, completeness, integrity or quality of any information, views, content or other material presented or otherwise made available at or through any Event.
d. Except for any liability that cannot be excluded by law, Sephora (including its affiliates and each of their officers, employees and agents) excludes all liability (including negligence), for any personal injury or any loss (including loss of opportunity), damage, expense or other costs arising in connection with the Event, including, but not limited to, any of the following:
i. any loss, damages or expense caused by or attributable in whole or in part to any participant’s own act, omission, default or failure to comply with any of the conditions set out in these Terms and Conditions;
ii. any indirect, incidental, consequential, special or exemplary costs, claims, expenses, loss or damages, even if informed of the possibility of such costs, claims, expenses, loss and damage;
iii. any equipment, system, satellite, network, server or connection failure, error, omission, interruption, delay in transmission, computer virus or other malicious, destructive or corrupting code, agent program or macros (whether or not under Sephora’s control), including where any attendance or participant in any Virtual Event is unsuccessful as a result;
iv. any theft, unauthorised access or third party interference; or
v. any claim that is late, lost, altered, damaged or misdirected (whether or not it is after receipt by Sephora) due to any reason beyond the reasonable control of Sephora.
e. To the maximum extent permitted by law, each participant agrees to indemnify Sephora against any losses, damages, costs, expenses, claims or liabilities of any kind arising in connection with his/her registration, attendance and/or participation in any Event.
8. Governing law and dispute resolution: All Events shall be governed by Australia law and each participant agrees to submit any claim, dispute or controversy to the exclusive jurisdiction of the courts of the Commonwealth of Australia.
